These Uptics TV App Terms of Use (the “Terms”) apply to you and govern your use of the Uptics TV mobile application (collectively referred to as the “App”). You should read these Terms carefully before using the App.

1. DEFINITIONS

• “We”, “us”, “Uptics” or “GNL” means Galavant Networks Limited, a company registered in Trinidad and Tobago, with its office at #230 Eastern Main Road, El Dorado (the “Company”).

• “You” means the person accessing or using the App or viewing its Content (and “your” shall have the same meaning).

• “Content” means information, audio, radio, podcasts, text, files, images, video, sounds, musical works, works of authorship, materials, applications, software, product names, company names, trade names, logos, designs, and any other materials or content.

• “Use” or “using” in these Terms means any time an individual (a “user”), directly or indirectly, with or without the aid of a machine or device, does or attempts to access, interact with, use, display, view, print, or copy from the App, transmit, receive, or exchange data, or in any way utilizes, benefits from, or interacts with any function, service, or feature of the App, for any purpose whatsoever.

By using the App, whether occasionally, frequently, or permanently, or by otherwise indicating your consent, you agree to be legally bound by these Terms.

You are also bound by all applicable terms and conditions of your prepaid or postpaid service, plans, bundles, promotions, subscriptions, transactions, and any other terms that apply to your use of the App (“Additional Terms”). Additional Terms are posted in the App and on Uptics websites. If any provision of these Terms conflicts with any term in any Additional Terms, the Additional Terms prevail.

If you do not agree to or accept any of these Terms, or if you are under the age of eighteen (18) and using the App or website without parental supervision, you should stop using the App immediately.

You may not transfer or assign any obligations or responsibilities arising from these Terms to third parties in any way whatsoever, and you may not make any third party a partner to responsibilities written in these Terms.

2. DESCRIPTION OF UPTICS TV

2.1.

Uptics TV is a reseller of sports and entertainment channels as well as local, regional, and international programming. We operate this App to provide you with online access to this content, as well as other content for which we have rights to provide through this App.

2.2.

Uptics may require specific access controls and will initially provide these services through prepaid user bundles to its customers. Uptics reserves the right to alter its method of service provision, plans, subscriptions, or charges at its discretion.

2.3.

To access the App, you must have internet access and may be required to register with the App using an Uptics ID to access certain content, which may be restricted.

2.4.

This App is intended for use by those who can access it within Trinidad. If you choose to access the App from a location outside of Trinidad, you are responsible for compliance with local laws where they are applicable.

2.5.

You accept that whether or not you are located within Trinidad, the App or certain content on the App may not be available in your country or in your preferred language. Content available in your current location may become unavailable to you if you travel to another location where content is restricted.

2.6.

We reserve the right to modify, suspend, remove, or disable access to the App and any content or other materials that are offered on the App at any time, without notice. We will endeavor to provide notice where possible, but this is not always within our control. Consequently, we are not responsible to you or any third party for any modification, suspension, removal, or discontinuance of the App.

3. RIGHTS, OBLIGATIONS, AND USE OF THE APP

3.1.

You shall be solely responsible for all necessary equipment, associated fees, and costs incurred for connectivity and data usage in relation to your use of the App.

3.2.

The App and all its content are available only for your personal and non-commercial use.

3.3.

If you register to use the App, you are responsible for maintaining the confidentiality and security of your account and password information. You agree to notify us immediately if the confidentiality of your account is compromised.

3.4.

You agree not to:
(a) use the App in any unlawful manner;
(b) interfere with the proper functioning of the App;
(c) use automated tools to access or copy App content;
(d) use the App in a way that disrupts user experience;
(e) use offensive or inappropriate language when interacting with customer support.

3.5.

You have the right to terminate your subscription to the App at any time by following the cancellation process within the App.

3.6.

By using the App, you may encounter content that may be considered aggressive, indecent, or offensive. You agree to use the App at your own discretion and risk.

3.7.

We have the right to terminate or suspend your account if you violate these Terms or any Additional Terms.

3.8.

We may limit the number of times you can access the App within a certain period. We also reserve the right to terminate your access to the App at any time without notice.

3.9.

You may use the App to purchase subscriptions securely.

3.10.

You agree to provide accurate payment details for subscription purchases and to never use another person’s payment details without permission.

3.11.

We do not guarantee the accuracy of information on the App regarding subscriptions, promotions, or pricing. We reserve the right to correct errors and cancel subscriptions if needed.

3.12.

Your privacy is important to us. We handle your personal information in accordance with our privacy policy, available here.

4. PROHIBITED USE

You agree not to:
(a) use the App for illegal activities;
(b) resell App services;
(c) bypass access restrictions;
(d) send deceptive information;
(e) collect personal information from other users;
(f) spam other users;
(g) reverse engineer any software in the App;
(h) send viruses or malicious software;
(i) overload or crash the App.

5. INTELLECTUAL PROPERTY RIGHTS

5.1.

The App, including all content, software, and trademarks, is owned or licensed by GNL and is protected by copyright and intellectual property laws. You may not copy, distribute, modify, or create derivative works based on the App.

5.2.

Unauthorized use of the App’s content may violate copyright, trademark, and other laws and may result in legal consequences.

6. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of Trinidad and Tobago. Any disputes shall be subject to the exclusive jurisdiction of the courts of Trinidad and Tobago.

By using Uptics TV, you acknowledge and agree to these Terms.
